Rep. Miller Asks Justice Dept. for Investigation of Possible Coercion of NLRB Member

Rep. George Miller (D-Calif.), the senior Democrat on the House Education and the Workforce Committee, asked the Department of Justice to look into evidence uncovered by a National Labor Relations Board Inspector General investigation that found board member Brian Hayes engaged in employment discussions with a law firm with business before the agency. Miller wrote:

The board plays a critical role in adjudicating and administering the rights of employees and employers under our nation’s labor law and Board members must be free of coercion and undue influence when executing their responsibilities.

The NLRB Inspector General investigation found that Hayes and an attorney with Morgan Lewis had a number of conversations beginning in late September or early October about potential employment if he were to resign his position on the NLRB. As part of those conversations, an attorney with the firm, according to Hayes, stated that “if you ever decide to resign we’d like to talk to you.”

    Very seldom do we ever get to see what is happening under the table when one foot kicks the knee of the other person seated across from them. The National Labor Relations Board Inspector General investigation has just given us an under-the-table view of the foot kicking the shin of the member of the National Labor Relations Board. The lawyer’s action should be a felony requiring twenty-years in prison without any possibility of parole!

    As a forcibly retired airline captain, this reminds me of how the age 60 rule was adopted by the FAA in 1959 when the first Admin of the FAA, Quesada was at the helm. Turns out that American Airlines head, Smith, wanted to get rid of his senior captains who had no jet experience as the airline was bringing in the 707. So he simply fired the captains when they turned age 60. Prior to that there was no age limit for flying in part 121 service.

    ALPA, the main pilots union went out on strike in their defense, and American lost. Smith then typed a letter to Quesada asking him to institute a new rule making age 60 the age limit. Quesada complied and the new rule was made out of the normal process with little comment or discussion. When our organization was researching the rule, the FAA said that all files relating to this rule were destroyed. A few months after the rule was made, Quesada resigned from the FAA and got a position on the board of American!

    ALPA had fought against this rule, then the junior members realized that this was a good deal for them, and voted to reverse ALPAs opposition. The AFL-CIO instead of demanding that a member union observe the maxim an injurty to one is an injury to all, went along with this outrageous age discrimination. They put their legislative muscle behind keeping this rule. Though I was not an ALPA member, I was a member of Teamsters, who supported changing the rule. As a result, ALPA got language inserted in the bill to kick me out of my job, along with all ALPA members over 60.

    I am outraged at the stance the AFL-CIO now has with regards to illegals who have NO right to even BE here, yet they could spit on we who are older, and overwhlmingly were all Vietnam era vets. This is the reason unions are in decline since the so called leaders are more concerned with political games than principles.

    Why would anyone be surprised that this goes on? Thank god they have been outed! Now maybe we can get stricter oversight of the board by labor and stop the anti worker decisions like we saw under the previous administration. I have had dealings with the firm Morgan Lewis and let me tell you if they are courting board members then it doesn’t bode well for us. Just in case someone doesn’t know they are a notorious union busting firm. These actions by the firm and the board member are just another example of the excessive $$$$$ in play in our government by corporate america.

    Sweartogod , Union members want companies to make profits. How else can you expect to have a job with good pay and benefits? Where I worked we did everything possible to make sure they were profitable. I don’t know where you work and what kind of people you work with if you all have your attitude.
    The trouble is that companies are not satisfied with a decent profit. They want us all to work for Chinese wages and benefits. Why else do you suppose thaey have the billions of dollars to finance all these campaigns? You can bet that money comes after they have taken profits. There is no way working people can compete with that kind of money.
    Do you not see all the stores , and other companies closing and going out of business. It is because of all the lost jobs that went to China, and the low wages the people who have jobs are making.

      I can agree with you Free Guy Md. I, too, worked hard for my company to make it profitable, but I can also tell you this–as the younger employees were hired they had a very poor attitude. I saw where they were literally ripping the company off. And what was even worse management did nothing about it.

      I see an obscene amount of small businesses going out of business. This happened when the WallyMart came in. Where I live there is a stinking WallyMart within a 10-mile radius of the first one built. And I am not exaggerating. Many of the small hardware, clothing, & food stores have closed. I refuse to shop at a WallyMart. And yet another one is going to be built about 12 miles to the West of where I live. I blame our county commissioners on this. What they (commissioners) do is offer these companies ‘free tax’ for 10 yrs. and guess what happens in ten years? They pull up ranks and leave. So no one can count on working for that company any longer then 10 yrs.

      God help America!!

    This is the exact kind of crap that needs to stop, this revolving door of people in government positions who do corporate favors then are given high dollar positions with the corporation the did the favor for.

    I suggest that all partners as well as any lawers of this law firm that were part of this extortion should be stripped of their right to practice law. That would send a message loud and clear.
